Working for the military and/or being a soldier does not inherently mean committing war crimes though. Every nation has military and they don't all deserve to be murdered sight unseen. If someone like Bradley wasn't at the top, they wouldn't be using state alchemists as war criminals, which is Mustang's whole point / goal. So it's still pretty immoral to kill people who have not committed any actions against you yet.

The srate alchemist are, by definition, military weapons. Scar is going after state alchemist because they are the military weapons that allowed the government to commit genocide. It doesn't matter if a current state alchemist wasn't one during the war. If the government decided to do this again, all state alchemists are required to do it again. They are specifically sponsored by the state to do research in exchange for being used as the greatest military weapon at a moment's notice. Not only is it immoral, but it's no different in than if Scar was sabotaging other military weapons. Ed isn't absolved of that because he willingly entered that contract, fully aware of that.
