Yup subtitles can be very misleading in this regard as japanese doesn't really use the concept of gender in the language. I mean they have words for "he" and "she" but iirc those too were only introduced when western media first started to become relevant in japan to be able to translate it. So for the most part its just neutral language and you get the gender from context. But of course in this case they don't know the gender so it's probably close to saying "they"/"them" in English (as in "Did they want the diary to be shown on TV?"). I love this concept of a genderless language btw. Japanese also doesn't have a plural form of nouns. Sounds weird at first because we are so used to western languages having it but it totally makes sense and massively simplifies a language.

They translated it as "he" but the word they were saying was "aitsu" which is a generally gender neutral term meaning "that person" in a disrespectful manner. Like "that guy is some piece of work" kind of feeling. So they weren't actually specifically going out of their way to refer to second Kira as a male, but it's safe to assume they assumed she was a man.
