The guard would be fine if he's going to the castle im sure they can clear things up then. freeing him now will just make things worse. also if theres a dragon horde in the badlands why are these guards not watching the border in case the dragons move towards them?

We can't help the guard now. A cockamamie rescue now would risk your ability to help the hive and would still not allow him to continue being a royal guard, since he'd have to hide from the law. Focus on the hive for now. Later you can work on helping him the right way; for now, a little time in jail isn't the end of the world.
