So, his soul wasn't following Ban, it was just around his freshly made grave. Him being there would make sense. The anime could have gone about showing it better though.

It's a serialized weekly manga to its bones and will have a dramatic thing happen to end a chapter and then retcon it the next (which for the anime often means the same episode) so the status quo isn't changed so much.
